Terms & Conditions



These conditions contain important terms which govern your business relationship with Alena. Therefore please read them carefully and keep the supplied copy available for reference.

1. Definitions

1.1 In these Conditions:

 “The Customer” means any person, undertaking, buying or offering to buy Goods from Alena:

“Goods” means all products supplied by Alena:

2.1 Orders are taken on receipt of the Internet, or by telephone call.

2.2 Ownership of the goods remains with Alena until full payment is received from the customer for those said goods.

3. Orders & Specifications

3.1 Alena shall not be liable in respect to any alleged defect in the goods as a result of any specifications made by the customer against the advice of Alena.

3.2 Alena may from time to time have to adjust its product specification without prior notification to the customer.

3.3 Once Alena have received a customers order, this will be prepared. Once preparation has been commenced the order cannot be cancelled in any way.

3.4 Due to colour sensitivity in fabrics Alena cannot guarantee Colour Fastness in any product.

4. Deliveries

4.1 Alena may without prejudice suspend or cancel delivery of goods if the customer is in breach of its contractual obligations with regard to the credit terms.

4.2 Alena will as far as possible attempt to meet orders received and accepted. All orders are accepted conditionally upon the availability of the goods ordered, and Alena shall not be liable for failure to meet any order or part thereof for any reason whatsoever.

4.3 Any dates quoted for delivery are approximate and Alena shall not be liable for any delays in delivery howsoever caused.

5. Prices

5.1 Alena may from time to time have to adjust its catalogue prices without prior notification.

5.2 All prices exclude HST and dispatch charges. HST will be added (where applicable) to the total order excluding postage & packing. Delivery costs are dependent on the size of your order, the destination and service used.

5.3 Alena require all goods to be paid for by the customer at the time of placing the order.

5.4 In the event that payment is not made, Alena have the right to withhold delivery of any further goods.

6. Returns

6.1 Made to measure items cannot be returned for refund/exchange or credit.

6.2 All Goods may be returned for exchange if they are found to be faulty, within 14 days of receipt of the goods. If goods are returned because the wrong size has been ordered, postage will be a charge for the customer to return item.

6.3 Should Alena deliver goods incorrectly then Alena will reimburse the return postage cost. Alena will re-deliver the replacement goods Post free. All returns must be authorized by Alena before any goods are returned.

6.4 Goods are returned for exchange at the customer’s cost.

6.5 Any claim based on a defect in quality or condition of goods supplied or failure to correspond with specifications must be notified to Alena within 14 days of receipt of goods. In the event that the fault is accepted Alena will replace the goods free of charge subject to availability.

6.5.1 It is advisable for “Proof of Posting” to be obtained.

7. Dealing with Goods

7.1 Customers are prohibited from reselling any Alena products without authorization from Alena.

8. Warranties & Liabilities

 8.1 Alena warrants that the goods sold will correspond with their description in the current Alena description.

8.2 Alena shall be under no liability in respect to any defect arising from fair wear & tear, customer negligence, willful damage, abnormal working conditions, failure to follow Alena’s instructions (written or oral). Misuse or alteration/repair of the goods without Alena’s approval.

8.3 Alena shall be under no liability as to the quality of the goods beyond the occasion of their first use.

8.4 Alena do not guarantee colours to be identical to that appearing on their website. Slight colour variation may occur due to variations in dye lots.

8.5 Alena do not guarantee their products to the fitness for the purpose intended by the customer. It is the customers’ responsibility to ensure that the goods are suitable for their own purpose.

8.6 The customer’s statutory rights are not affected by these terms & conditions.

9. General

9.1 All correspondence/notices shall be addressed to either parties registered office or principal address that we have on record at the time.

9.2 No waiver by Alena of any breach of the contract by the customer shall be considered as a waiver of any subsequent breach of the same or any other provision.

ACKNOWLEDGEMENT by receiving these terms & conditions it is implied that the customer agrees and abides by them.

10. Method of Payment

10.2 When sending payments from overseas, ALL CHARGES must be paid by yourself so that Alena receive the full funds required.
